Landlord Legal Expenses and Rent Guarantee

Landlord legal expenses insurance is an extra level of cover designed to complement your customers landlord policy and cover areas the main policy may not.  Our Premier Landlord Legal Expenses and Rent Guarantee covers legal costs related to issues with your rental property up to maximum total of £500,000, including legal action and court proceedings.

Cover includes:

  • Property owners’ legal expenses

Property disputes:

Legal expenses incurred in disputes or legal proceedings made by or brought against the insured regarding:

  • The possession of the insured property
  • The terms of the tenancy agreement
  • Damage caused by actual or alleged nuisance
  • Dilapidations to the insured property
  • Nuisance emanating from the insured property; subject (in respect of damage and dilapidations) to the claim being in excess of £1,000 and legal expenses being limited to 75% of the amount in dispute.

Repair and renovation disputes:

Legal expenses incurred in contractual disputes with a contracting party over the repair or renovation of the insured property. The amount in dispute must exceed £1,000 and the contract value must not exceed £100,000.

Health & safety prosecutions: Legal expenses incurred in defending a criminal prosecution of the insured which is brought under the Health & Safety at Work Act 1974; or an appeal by the insured against the service of an Improvement or Prohibition Notice under the Health & Safety at Work Act 1974.

Tax protection:

Professional expenses incurred in respect of representation of the insured during an HMRC investigation

  • Rent protection

Eviction:

Legal expenses incurred in evicting the tenant from the insured property for either non-payment of rent or at the expiry of the tenancy. Rent arrears must be greater than £250. Up to £50,000 of advisors’ costs per claim.

Rent protection:

Rent arrears due from the tenant under the tenancy agreement where the insured has notified and is pursuing a claim under the Eviction.  The monthly rent shown in the tenancy agreement and the policy schedule up to a maximum of £2,500 per month. The maximum rent payable per claim is £25,000 or the equivalent of 12 month’s rent, whichever is the lesser amount.

  • Attendance expenses

Actual loss of salary or wages by the insured, up to £100 per person per day to a maximum of £1,000 per claim, for the time off work to attend any court or tribunal hearing as a witness or defendant in legal proceedings for which the insurer has accepted the claim.

Cover is subject to a Limit of Indemnity of £100,000 for any one claim, up to a total of £1,000,000 during the period of Insurance. Landlord Home Emergency cover optional to add to this policy.
